Take Advantage of the $8,000 Tax Credit for First-Time Home Buyers: Now Buyers Can Use the Credit as a Down Payment!

On February 17, President Obama signed the American Recovery and Reinvestment Act of 2009 into law. As part of $787 billion in economic stimulus measures, the legislation created a home buyer tax credit that is bigger and better than the previous credit that was implemented in July 2008.

The tax credit is specifically for first-time home buyers and will make the past to first-time homeownership much easier.

Buyers can also monetize the $8,000 tax credit and use it toward a down payment or closing costs for their new home purchase.  On Monday, May 29, Shaun Donovan, Secretary of the Department of Housing and Urban Development, announced a decision to allow FHA-approved lenders and agencies to grant short-term loans to those who would be able to claim the credit.

Click here for a copy of the mortgagee letter detailing the ways first-time home buyers can use the $8,000 credit, including as a down payment.  Click here for a video of Secretary Donovan's speech to members of the National Association of Home Builders.

But you need to act fast! The new tax credit expires on November 30, 2009.  For more information about the tax credits and for answers on specific questions, please view the 7-minute public service announcement below from the NAHB:

The Web site www.FederalHousingTaxCredit.com explains in detail the provisions of the new tax credit. In a nutshell, it:

  • Provides a tax credit equal to 10 percent of the sale price of the home, up to an $8,000 maximum. This is a true tax credit. It does not need to be repaid like the tax credit it replaces, unless the home owner sells the home within three years of the purchase.
  • Can only be used with the purchase of a home that will be the buyer’s principal residence. It cannot be claimed for the purchase of a vacation home or property to be used as a rental.
  • Available to first-time home buyers only. A first-time home buyer is defined as someone who has not owned a principal residence in the last three years. For married taxpayers, the law tests the homeownership history of both the home buyer and his or her spouse.
  • Applies to homes purchased by qualified buyers between Jan. 1 and Nov. 30, 2009. The purchase date is the date when closing occurs and the title transfers.

The new tax credit provides an unprecedented opportunity for people looking to buy their first home. Not only will they receive an $8,000 tax credit, they also will be taking advantage of record-low interest rates. There also is a good selection of new homes from which to choose in the Upstate housing market. However, don’t delay; new homes are selling well and inventories of new homes are falling.  This opportunity won't be around forever.  Keep in mind that you have to purchase your house on or before November 30.  To search for your new home, please visit the Consumer Resources section of our website for links to local member home search sites.
